Your Rights Before and During Bankruptcy

There should be no stigma or shame attached to filing bankruptcy; if you qualify, bankruptcy is your right. In addition to being able to discharge or reorganize your debt through the bankruptcy process, you have other rights, including:

  • The right to protection from creditor harassment. This provision of the bankruptcy law, known as the automatic stay, goes into effect once you file bankruptcy.
  • The right to be free from abusive and unfair debt collection practices, even before you file bankruptcy (Fair Debt Collection Practices Act)
  • The right to have your credit status recorded and acted upon correctly (Fair Credit Reporting Act)
  • The right to privacy about your financial status. Bankruptcy laws do not require the court to notify your employer, your neighbors or your family.
  • The right to select the debts that you want discharged or reorganized. Remember, however, that if you do not list a debt, you are still liable for it and do not have the protections that bankruptcy provides.
